Kansas Clinic Law Faces another Obstacle

The state of Kansas is again preparing to defend itself against another lawsuit that seeks to block a new law that establishes minimum safety standards for abortion clinics.

This latest lawsuit was filed by the Center for Reproductive rights, a pro-abortion legal group based in New York. Kansans for Life’s Mary Kay Culp, in an interview said that the Center objects to health officials and law enforcement inspecting abortion clinic records to ensure that they comply with state safety standards for abortions. She said, “The truth is it was never about safety [for them] — it was always about access. And things like this lawsuit bear that out.”

In setting up standards for Kansas, state officials patterned them after those that are used by South Carolina. These standards have been upheld in federal court. Culp said that this was not the only resource used in developing the Kansas standards.

She said, “We also looked at the National Abortion Federation’s own stated standards about abortion clinics. But those seem to live in a file cabinet somewhere and come out when it’s convenient for them.”

Culp also said, “When someone actually designs standards based on [their own guidelines], they’re the first ones to complain.”

According to the state’s new law, abortion clinics must meet standards on health and safety, such as, “having an emergency door that can accommodate a gurney … maintaining proper emergency equipment, drugs and protocols, having proper lighting and ventilation, lavatory areas, and spaces for the sterilization of surgical equipment.”

The health and safety standards also call for clinics to have a licensed nurse in the premises when abortions are done.
