License Applications for Internet Poker to be Accepted by State Beginning February

A state gaming regulator revealed that applications will be accepted beginning February by the state Gaming Control Board to license companies who are interested to operate Internet poker sites.

Mark Lipparelli, the chairman of the Control Board, in a two-day U.S. Online Gaming Law conference held at Aria last Thursday, told industry professionals that the agency is prepared to commence investigations that month.

He said that the process will be faster for companies that are already holding other licenses in the state of Nevada. Once companies get a license, they will be allowed to offer online poker play within the boundaries of the state in a closed-loop setting similar to how other companies offer sports betting by telephone or online.

The Nevada-licensed online poker companies, however, will still not be allowed to offer online poker play to those who are living outside the borders of Nevada.

Companies are prohibited by the federal Unlawful Internet Gambling Enforcement Act to accept payments that are related to online betting, but allow a couple of exceptions, which include intrastate and intra-tribal betting and fantasy sports.

Those companies that already have other Nevada license would have the new title appended to their licenses while companies that are new to the state would be vetted with complete licensing investigations, which usually takes several months. Current licensees who are applying for an online poker license will have to demonstrate that their technology will be able to limit poker play to residents of the states who are of legal age.

Lipparelli said, “We’ve taken our brick-and-mortar operational standards to a new level. We’re going to continue to be flexible, but we think we’ve set the bar high for licensing and suitability.”
